1. ACCEPTANCE OF TERMS
Welcome to This-MAN (“Platform,” “we,” “us,” or “our”). By accessing, browsing, or using www.man.co.ke, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree with any part of these Terms, you must not use this Platform.
These Terms apply to all users: Customers (purchasers), Vendors (sellers), and Visitors (browsers).
2. THE THIS-MAN MARKETPLACE
2.1. Our Role
This-MAN is an online brands platform that connects independent vendors selling men’s products with customers. We are not a seller, manufacturer, or retailer of the products listed. We provide the technology, hosting, and payment infrastructure but do not:
– Take ownership of products
– Guarantee product quality or authenticity (unless specified)
– Handle shipping or delivery directly (unless specified)
– Act as an agent for either party
2.2. Transactions
Each sale is a direct contract between the Vendor and Customer. This-MAN facilitates but is not a party to this contract.
3. ACCOUNT REGISTRATION & RESPONSIBILITIES
3.1. Eligibility
You must be:
– At least 18 years old
– A resident of Kenya or authorized to conduct business in Kenya
– Able to uphold the entrepreneurial conduct for a conducive business environment
– Using the Platform for legitimate purposes
3.2. Account Security
You are responsible for:
– Providing accurate, current, and complete information
– Maintaining password confidentiality
– All activities under your account
– Immediately notifying us of unauthorized access at support@man.co.ke
3.3. Vendor Verification
Vendors must provide:
– Valid business registration documents (if applicable)
– KRA PIN certificate
– Valid identification
– Bank/M-Pesa details for payouts
We reserve the right to verify documentation and suspend accounts pending verification.
4. PRODUCT LISTINGS & PURCHASES
4.1. Vendor Responsibilities
Vendors must:
– Provide accurate, complete product descriptions and images
– Clearly state pricing in Kenyan Shillings (KES)
– Maintain adequate stock levels
– Fulfill orders within stated timelines
– Handle customer inquiries promptly
– Comply with all Kenyan consumer protection laws
4.2. Prohibited Products
Vendors must not sell:
– Counterfeit or fake items (especially perfumes, branded goods)
– Dangerous or illegal car accessories (non-compliant rims, unsafe modifications)
– Used intimate wear (socks, underwear)
– Weapons, ammunition, or related items
– Illegal or regulated substances
– Theft or stolen items/property
– Products violating intellectual property rights
4.3. Customer Responsibilities
Customers must:
– Verify product suitability before purchasing
– Provide accurate shipping information
– Make timely payments
– Inspect deliveries upon receipt
– Communicate issues within 24 hours of delivery
5. PAYMENTS, FEES & TAXES
5.1. Accepted Payment Methods
– M-Pesa
– Credit/Debit Cards (via secure payment gateway)
– Bank Transfers (for selected vendors)
– Other approved Kenyan payment methods
5.2. Pricing
All prices are in KES unless specified otherwise. Prices include VAT where applicable but exclude:
– Shipping costs (stated separately)
– Any customs/duties for international orders
5.3. This-MAN Fees
– Customers: No platform fees for purchases
– Vendors: May be subject to commission fees as per separate Vendor Agreement
5.4. Taxes
Vendors are responsible for:
– Collecting and remitting applicable taxes (VAT, income tax)
– Including tax in product pricing where required
– Providing tax invoices upon request
This-MAN is not responsible for vendor tax compliance.
6. SHIPPING, DELIVERY & RETURNS
6.1. Shipping
– Vendors determine shipping methods, costs, and timelines
– Vendors must provide tracking information where available
– Customers must ensure accurate, accessible delivery addresses
6.2. Delivery Issues
– Report damaged/missing items within 24 hours
– Provide photographic evidence when requested
– This-MAN may mediate but is not liable for delivery failures
6.3. Returns & Refunds
Governed by our Refund Policy. Key points:
– 30-day return window for eligible items
– Non-returnable items: opened perfumes, custom suits, installed car accessories

7. INTELLECTUAL PROPERTY
7.1. Platform Content
All This-MAN content (logo, name, design, text, software) is owned by or licensed to us. You may not:
– Copy, modify, or distribute our content without permission
– Use our brand name or logo without authorization
– Reverse engineer our platform
7.2. Vendor Content
Vendors retain ownership of their product images and descriptions but grant This-MAN:
– A worldwide, royalty-free license to display and promote their content
– The right to remove content violating these Terms
7.3. Counterfeit Goods
Zero tolerance for counterfeit products. Violations result in:
– Immediate account suspension
– Forfeiture of pending payments
– Legal reporting to Kenyan authorities (ACA, KEBS)
8. PROHIBITED CONDUCT
You agree not to:
– Circumvent our payment system (“off-platform” transactions)
– Harass, threaten, or defraud other users
– Use automated tools to scrape data or place orders
– List products in incorrect categories
– Manipulate reviews or ratings
– Violate any applicable Kenyan laws
9. DISPUTE RESOLUTION
9.1. Direct Resolution
Parties must attempt to resolve disputes directly before escalating.
9.2. Platform Mediation
If unresolved within 7 days, contact disputes@man.co.ke. This-MAN may:
– Request evidence from both parties
– Propose a resolution
– Make a binding decision (if both parties agree to mediation)
9.3. Legal Recourse
Unresolved disputes may be referred to:
– Kenyan Courts: Exclusive jurisdiction in Nairobi, Kenya
– Alternative Dispute Resolution: As per Kenyan law
10. LIMITATION OF LIABILITY
To the maximum extent permitted by Kenyan law, This-MAN is not liable for:
– Product quality, safety, or authenticity issues
– Vendor actions or omissions
– Delivery delays or failures by third-party couriers
– Indirect, incidental, or consequential damages
– Losses exceeding the purchase price of the item
11. INDEMNIFICATION
You agree to indemnify and hold harmless This-MAN, its officials, employees, and affiliates from any claims, damages, or expenses arising from:
– Your violation of these Terms
– Your products or content
– Your interactions with other users
12. TERMINATION
We may suspend or terminate accounts for:
– Violation of these Terms
– Fraudulent activity
– Legal or regulatory requirements
– Inactivity for over 12 months
Upon termination:
– Pending orders will be completed or refunded
– Vendors receive final payouts minus any charges
– Account data may be retained as per Privacy Policy
13. MODIFICATIONS TO TERMS
We may update these Terms. We will notify users via:
– Email to registered users
– Banner notification on the Platform
– Updated “Last Updated” date
Continued use after changes constitutes acceptance.
14. GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of Kenya, specifically:
– The Data Protection Act, 2019
– The Consumer Protection Act
– The Kenya Information and Communications Act
